You agree to use the App in compliance with all applicable laws, regulations, and these Terms.

No account is required to use the App.

BGM Alarm lets you set your own audio as an alarm sound — for example a file you import, the audio from a video in your library, or a recording you make. You are responsible for ensuring that you have the rights to use any audio or other content you choose, and you agree not to use content that infringes the rights of others.

• The audio and content you choose remain stored on your device.
• We do not have access to view or retrieve your content, and we cannot recover deleted items.
• You retain ownership of any content you create or import using the App.

The App uses Apple's AlarmKit so alarms can ring through Silent Mode, Focus, and Do Not Disturb. However, alarms depend on your device and its operating system, and may not sound if your device is turned off, out of battery, damaged, or otherwise unavailable.

You should not rely solely on the App for critical wake-ups or time-sensitive obligations. We do not guarantee that any alarm will sound, and we are not responsible for any consequences of a missed or delayed alarm.

The optional Adaptive Wake Sound feature reads your recent sleep from the Health app to choose a gentler wake sound. It is a convenience feature only, is not a medical or health service, and should not be relied upon for any health, wellness, or medical decision.

Your privacy is important to us. Please review our Privacy Policy to understand how we handle your information.

By using the App, you consent to the handling of your information as described in our Privacy Policy.

You agree not to engage in any conduct that violates these Terms or infringes on the rights of others.

Prohibited conduct includes, but is not limited to, using the App for illegal or unauthorized purposes, attempting to disrupt or reverse-engineer the App, and using content you do not have the right to use.

The App, including all of its features and functionality, is owned by us and protected by intellectual property laws. You may not modify, reproduce, distribute, or create derivative works based on the App without our prior written consent.

The App is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied.

We do not warrant that the App will be uninterrupted or error-free, or that any defects will be corrected.

In no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the App, including any missed or delayed alarm.

These Terms shall be governed by and construed in accordance with the laws of Ontario, Canada, without regard to its conflict of law provisions.

We welcome and appreciate user feedback and suggestions. By providing feedback or suggestions, you grant us the right to use and implement such feedback without compensation or credit.

We reserve the right to modify or replace these Terms at any time. Any changes will be effective immediately upon posting the revised Terms.

Your continued use of the App after any such changes constitutes your acceptance of the new Terms.
