These Terms & Conditions govern your use of the Eclipse mobile iOS application provided by creators Matthew Siu and Cindy Cheng. 

By accessing or using the App, you agree to comply with these Terms. If you do not agree with any part of these Terms, you may not use the App.

You agree to use the App in compliance with all applicable laws, regulations, and these Terms.
Users are not required to create accounts to use the App.


Users may create and/or upload content, such as photos and videos, through the App. It is important to note that:


• Uploaded content will remain stored exclusively on the user's device, in a secure, encrypted format within a designated folder that is inaccessible to anyone other than the owner. 
• The Creators do not have access to view or retrieve uploaded content.
• The Creators cannot recover deleted items
• You retain ownership of any content, including photos and videos, that you create or upload using the App.

• Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.
• By using the App, you consent to the collection, use, and disclosure of your information as described in our Privacy Policy.

• You agree not to engage in any conduct that violates these Terms or infringes on the rights of others.
• Prohibited conduct includes, but is not limited to, using the App for illegal or unauthorized purposes, attempting to access or disrupt the App's servers, and impersonating another person or entity.

The App, including all features and functionality, is owned by us and protected by intellectual property laws. You may not modify, reproduce, distribute, or create derivative works based on the App without our prior written consent.

The App may offer in-app purchases. By making in-app purchases, users agree to the terms and conditions set forth by Apple Inc. for the App Store.

The App offers subscription plans for premium features, which are subject to the following Subscription Agreement:

• Subscription plans are billed on a recurring basis until canceled by the user.
• Users may cancel their subscription at any time through their account settings on the App Store.
• Subscription fees are non-refundable, except where required by applicable law.
• The Creators reserve the right to modify or terminate subscription plans or features at any time.
• Users are responsible for all charges incurred through their subscription, including applicable taxes.
• By subscribing to a plan, users agree to the terms set forth by Apple Inc. for in-app purchases and recurring billing.

• The App is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied.
• We do not warrant that the App will be uninterrupted or error-free, or that any defects will be corrected.

In no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the App.

These Terms shall be governed by and construed in accordance with the laws of Ontario, Canada; without regard to its conflict of law provisions.

We welcome and appreciate user feedback and suggestions. By providing feedback or suggestions, users grant the Creators the right to use and implement such feedback without compensation or credits given.
